Beta software, development use only. Novarelynx is a new product currently in beta. It is provided for development, testing, and evaluation purposes only, and is NOT intended, warranted, or recommended for production use, business-critical workloads, or any use case where downtime, data loss, or a security issue could cause you harm. Use it accordingly, and do not rely on it as your sole or primary infrastructure for anything important.
By creating an account or otherwise using Novarelynx (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use of the Service after a change is posted constitutes acceptance of the updated Terms.
Novarelynx exposes an application running on a user's own computer to the public internet through a relay/tunnel, along with an account dashboard, API keys, and subscription plans. The Service is currently in beta (see above) and may change, be interrupted, or be discontinued at any time without notice.
You must provide accurate information when creating an account and are responsible for safeguarding your API key and account credentials. You are responsible for all activity that occurs through your account. You must be legally able to enter into these Terms in your jurisdiction to use the Service.
Paid plans are billed in advance on a recurring (monthly or annual) basis through our payment processor, Stripe. Subscriptions renew automatically until cancelled. You may cancel or change your plan at any time from your account dashboard's billing portal; cancellation takes effect at the end of your current billing period, and access to paid-plan features continues until then. Except where required by law, payments are non-refundable, including for partial billing periods. We may change pricing for future billing periods with reasonable notice.
You agree not to use the Service to host, relay, or distribute unlawful content; to violate any third party's rights; to distribute malware or engage in phishing or fraud; to attempt to disrupt, overload, or gain unauthorized access to the Service or other users' accounts; or to otherwise abuse the Service in a way that harms us or other users. We may suspend or terminate accounts that violate this section.
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access to the Service, with or without notice, for violation of these Terms, non- payment, suspected abuse, or if we discontinue the Service, in our sole discretion. Given the Service's beta status, we may also discontinue it entirely with reasonable notice where practical.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. AS BETA SOFTWARE, THE SERVICE MAY CONTAIN BUGS, EXPERIENCE DOWNTIME OR DATA LOSS, OR CHANGE WITHOUT NOTICE. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL NOVARELYNX, ITS OPERATOR, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Novarelynx, its operator, and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, the content or application you relay through it, or your violation of these Terms.
These Terms are governed by applicable law without regard to conflict-of-law principles, to the extent permitted. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
We may revise these Terms at any time by posting an updated version at this URL. Material changes will update the "Last updated" date above. Your continued use of the Service after changes are posted means you accept the revised Terms.
